A family was
driving along a road when a drunk driver struck their car. The mother
was killed and the two passengers in her car, including her son, were
severely injured. The defendant was clearly intoxicated and at-fault for
the accident. However, he did not have any motor vehicle insurance. The
mother and her family had uninsured motorist coverage on their cars. The
car involved in the accident had only a low amount of uninsured motorist
coverage. Her parents, with whom she and her son lived, had a higher amount
of uninsured motorist coverage on their car. Despite an exclusion in the
policy, we were able to convince the courts to stack the two uninsured
motorist policies, which resulted in a favorable settlement of the case.
